This is a good article. It however fails to respond to the cricisms raised against its use in Nigeria by the Nigerian Bar Association and some judges.
In addition, as at now its application can be viewed to be discriminatory as only the EFCC Act, 2004 permits it. The bulk of Nigerian criminal law is state law and none of the states' criminal codes contain any plea bargaining.
EFCC law concerns economic and financial crimes usually commiteed by the powerful, the high and mighty in the Nigerian society. It is not extended to other petty crimes. So, other criminals could be right to see its use as designed to assist the powerful away from long prison sentences.
